Should we let the seller stay for 45 days after closing when our rental ends sooner?

Housing category photographHousing

The seller offered $60 a day to stay in the house for 45 days after closing. My partner said that would help with our overlap costs. I counted the dates again: our current rental ends 40 days after the proposed closing.

This is a US purchase. The seller's new home isn't finished, and the builder hasn't given them a firm move-in date. I understand why they want somewhere to stay. We like the house enough to consider the request, but I had pictured closing as the point when we could start moving our own belongings in.

We haven't signed an occupancy agreement or asked our lender, insurer and legal adviser how the arrangement would affect us. The proposed daily payment answers one money question. It doesn't tell me where we would be on day 41, or what would happen if the seller's next home was still unavailable at the end of the agreed period.

What would we need to understand before agreeing? I want to consider a reasonable request without quietly making the uncertainty in their building schedule part of our own housing plan.

The proposed dates already leave a five-day gap before any overrun. Work out whether you have an affordable, genuinely available place for that period before evaluating the $60 daily payment. The arrangement needs to fit the time you can actually remain in your rental.

NAR's [consumer guide](https://www.nar.realtor/the-facts/consumer-guide-real-estate-contract-contingencies) describes rent-back terms as something to address in the purchase contract. Have qualified local advisers review the arrangement and confirm lender and insurance requirements. A daily rate alone isn't the full agreement.
